If you are involved in a medical malpractice case, you may need testimony from a medical expert witness. This is probably someone who works in the same industry and who is a part of the medical profession. They help to inform the judge and the jury about certain facts that may not be common knowledge, but which they understand as an industry insider.
Often, the job of the expert witness is to explain to the court what the typical standard of care would be in that specific situation. The court can then determine if that standard of care was upheld or not. If it was not, then this could mean that you are successful in your medical malpractice case. The doctors did not give you proper care, their negligence caused harm and you deserve financial compensation.
What is the standard of care?
There is no overall standard of care that applies to the medical profession in general. It is going to be unique in every case, but it just means that the doctor acted properly and gave you the type of treatment you would have received anywhere else.
For example, perhaps harm was caused when a surgeon left implements inside after surgery. The medical expert witness could describe the process of counting these medical implements and what the team is supposed to do to ensure that they are all recovered. If your surgical team did not do the count at the appropriate times, this demonstrates that they were negligent.
